The Ministry of Social Policy presented and submitted for public discussion its draft law, the full name of which is “On Amendments to the Penitentiary Code of Ukraine and the Criminal Procedure Code of Ukraine regarding the procedure for paying pensions to persons who have committed a crime against the foundations of Ukraine’s national security,” NaPensii reports..
As People's Deputy Mikhail Tsymbalyuk said, the draft law proposes to stop paying pensions to persons sentenced to restriction or imprisonment for committing criminal offenses.
Namely:.
for actions aimed at forcibly changing or overthrowing the constitutional order or seizing state power (Article 109 of the Criminal Code of Ukraine);
for encroachment on the territorial integrity and inviolability of Ukraine (Article 110 of the Criminal Code of Ukraine);
for high treason (Article 111 of the Criminal Code of Ukraine);
for collaboration activities (parts three - eight of Article 111 of the Criminal Code of Ukraine) (hereinafter - criminal offenses against the national security of Ukraine).
Basically, payments are planned to be stopped as soon as the guilty verdict of the court comes into force..
But the law is also going to be applied to those suspected of these crimes who are wanted and/or are hiding from the investigation, including. abroad or in the occupied territories of Ukraine.
After the release of the criminals will return the pension. For those who reach retirement age while serving their sentence, a pension will also be awarded after the expiration of the prison term..
