This is stated in the resolution of the Cabinet of Ministers of Ukraine dated December 27, 2022. №1449.
The discrepancy of the employee to the position held for health reasons is confirmed by one of the documents containing the information given in the primary records of the healthcare institution, namely:.
a certificate of a healthcare institution containing information on the conclusion of the medical advisory commission on changing the place of work, indicated in the log of the conclusions of such a commission;
notification of the employer about the group of disability and its cause, or an extract from the inspection report of the medical and social expert commission, or an individual rehabilitation program (subject to its provision by the person);
a medical certificate on passing a preliminary (periodic) medical examination of an employee of a certain category, issued by the commission for medical examinations of healthcare institutions.
On the basis of one of these documents, the employer is obliged to transfer the employee, with his consent, to another job - temporarily or without a time limit, or draw up an act on the absence of vacancies.
If the employee refuses to transfer, the employer must obtain the consent of the trade union to dismiss.
In turn, a person dismissed on such a basis and having an insurance period necessary for assigning an old-age pension in the minimum amount has the right to apply for a pension if such dismissal occurred no earlier than 1.5 years before reaching retirement age.
The application is accompanied by a copy of the document on the identified discrepancy between the employee and the position held for health reasons and other documents necessary for the appointment of an early retirement pension.
