Alimony debts: what punishment to expect for debtors

In Ukraine, administrative, civil or criminal liability may be faced by those who do not pay child support. If administrative and civil restrictions do not affect the debtor, then he can be held criminally liable, writes NV.

Who faces administrative liability for non-payment of alimony.

According to the Administrative Code, it is supposed to bring the debtor for the payment of alimony to administrative responsibility, in particular:.

deprivation of the right to receive a housing subsidy;

appointment of socially useful works for a period of 240 to 360 hours.

Also, a debtor who does not pay alimony for the maintenance of a sick child for three months may temporarily establish the following restrictions:.

for travel outside Ukraine:.

the right to drive vehicles;

for the use of weapons and hunting.

Civil liability for non-payment of alimony.

According to the Civil Code, penalties are expected to be charged for non-payment of alimony. Parents who do not pay child support for a long time are subject to the following financial sanctions:.

for non-payment of alimony for more than one year - 20% of the amount of unpaid alimony;

more than two years - 30% of the amount of unpaid alimony;

more than three years - 50% of the amount of unpaid alimony.

Who can be prosecuted.

The Criminal Code of Ukraine notes that malicious evasion from paying the funds established by a court decision for the maintenance of children (alimony) is punishable by:.

community service from 80 to 120 hours;

arrest up to three months;

restraint of liberty up to two years.



It should be noted that for a similar act committed by a person who previously had a criminal record, the punishment will be more severe, namely:.

community service – from 120 to 240 hours;

arrest - from three to six months;

restriction of freedom - from two to three years.
