The execution of the Stockholm arbitration award in the dispute between the Russian concern and the Ukrainian state company Naftogaz under the contract for the transit of gas through the territory of Ukraine is suspended.

This step in the Russian company was explained by the fact that the arbitration award on the transit contract was appealed, and the Ukrainian side before the consideration of the complaint in essence is trying to begin the procedure of enforcement of the decision in various jurisdictions. "The Court of Appeal agreed that there are sufficient grounds for suspending the execution of the Stockholm Arbitration Award.

The issuance of the order deprives NAK Naftogaz of Ukraine, including the grounds for attempts to seize Gazprom's assets abroad. This circumstance will be used by Gazprom when appealing against bailiffs in Switzerland and the Netherlands, "the Russian gas monopoly. Ukrainians confirmed that the Court of Appeal suspended the arbitration award. "The court decision was taken by the court without calling Naftogaz and, accordingly, without taking into account the explanations and arguments that would have been submitted by Naftogaz if the court had notified him of the existence of such a petition," the representatives of the Ukrainian side. According to employees of "Naftogaz", the decision of the appellate instance "is temporary". "The company will soon file its detailed explanations and counter-arguments with the court and expects that, taking them into account, the court will cancel the decision to suspend," insist in Kiev. Meanwhile, Gazprom pointed out that in accordance with the law of Sweden "On Arbitration" the order of the Court of Appeal can not be appealed. The Ukrainian side agreed to suspend for the time being all the actions to recover from Gazprom compensation for lost revenue from the transit of blue fuel to Europe. The Stockholm arbitration on February 28 made a final decision on the dispute between Gazprom and Naftogaz of Ukraine over the transit of gas through the territory of Ukraine. The Russian company was ordered to pay $ 2.6 billion to the Ukrainian side for insufficient transit volumes.

In the "Gazprom" believe that the decision was made with gross procedural violations. In late May - early June, Naftogaz of Ukraine, with the help of the Swiss and Dutch authorities, took action to enforce the decision of the Stockholm Arbitration. The property of the "daughters" of Gazprom was imposed with a security arrest. The Russian concern responded by challenging the actions of bailiffs in Switzerland. A similar statement will soon be filed in the Dutch court.
