The Supreme Court refused to satisfy the appeal of the NBU

The Supreme Court upheld the decisions of the previous courts, but left the possibility of filing a counterclaim as separate on a common basis.

The Supreme Court refused to satisfy the cassation of the National Bank of Ukraine and upheld the decisions of the courts of previous instances, according to which the NBU returned its counterclaim to the ex-owner of Pravtbank Igor Kolomoysky to recover 4.26 billion UAH. Initial lawsuit against NBU filed by ex-owner of PrivatBank. In it, Kolomoisky challenged the loan agreements of 2008-2015 concluded between the National Bank and Privat Bank (on refinancing), as well as guarantee contracts for refinancing.

The courts of the first, appeal and cassation instances refused to restore the deadline for filing a counterclaim by the National Bank and, accordingly, returned to the NBU its counterclaim, in which the NBU requested to recover UAH 4.26 billion from Kolomoisky (of which UAH 3.5 billion is inflationary losses, and.

On December 24, the Supreme Court upheld the decisions of the previous courts. At the same time, the Supreme Court noted that “the return of a counterclaim in the framework of this case is not an obstacle to access to justice, because the participant in the case is not deprived of the opportunity to file such a claim as a separate one on general grounds”.



The Economic Court of the Dnipropetrovsk region opened the proceedings and began consideration of the case on the recovery of 4.86 billion UAH from Kolomoisky in favor of the NBU. In Geneva, the NBU is also trying to recover from Kolomoisky debt on refinancing loans - the one that has accumulated since 2016.

The total debt of PrivatBank on refinancing loans, the repayment obligations of which was undertaken by Kolomoisky, is 9.2 billion UAH. It is reported by LIGABusinessInform.
