Deferment from conscription: what to do if it is not automatically extended

General mobilization and martial law continue in Ukraine. During this period, men liable for military service who receive summons are subject to conscription. But some are entitled to a deferment. Lawyer Daria Tarasenko on the air of Ukrainian Radio told what to do if the deferment was not automatically extended.

She explained that Ukrainians whose mobilization deferment was not extended after November 1 must go to the Administrative Services Center (ASC) to extend it.

According to Tarasenko, there are two categories of citizens who need to go to the Central Administrative Service with documents. The first is men who already had a deferment, but it was not automatically extended.

“They need to contact the Central Administrative Office as soon as possible so that they can, in fact, extend, but from a legal point of view, formalize this deferment. The second category is those who have never applied for a deferment and are now doing it for the first time. They also apply to the Central Administrative Service with a full package of documents,” she said.

The expert noted that the difference is that previously you had to go to the TCC with a prepared application in an approved form and a package of documents, but now there is no such application.

“You provide documents (originals or duly certified copies) to the Central Administrative Administrative Office, on their basis the administrator enters information into the program and this program itself will generate the appropriate application. And the employee will scan the documents. They will be transferred to the TCC and the joint venture for consideration by the commission,” she added.

Tarasenko emphasized that it is very important to have confirmation of submitting a package of documents for deferment. According to her, the Cabinet of Ministers Resolution No. 560 states that from the moment when a person liable for military service applied for a deferment, and until this application is considered, a ban on mobilization applies.

“That is, the presence of evidence that the application has been submitted for consideration is insurance against mobilization until the commission decides to postpone. The resolution now states that when the administrator of the Central Administrative Authority accepts a package of documents, he issues a description of the accepted documents with the seal of the Central Administrative Authority and the signature of an authorized person. This document confirms that the application for deferment has been accepted. It should be stored,” the expert said.

She added that the very next day after submitting documents to the Central Administrative Office they will be in the commission. The consideration period cannot exceed two weeks - this is the maximum period within which a decision must be made.

Earlier, the press service of the Ministry of Defense said whether recruits are paid for the period of basic combined arms training (BOVT).
