In Ukraine, a delay in mobilization is valid for men with disabilities, but there are exceptions. If such people are called up for military service, when the military medical commission recognizes them suitable for it, mobilization is still impossible without their consent.

She recalled that Article 23 of the ZU "

" And in the event that a man is recognized as suitable for military service, then his mobilization without his consent is impossible, ”the lawyer said.

Recall: on May 18, 2024, a law entered into force, making changes to the mobilization of people with disabilities, according to which people of all three disability groups should be exempted from military service.

However, people whose disability was established? After February 24, 2022, they were obliged to take a review. This applies to men aged 25 to 50 years. In addition to those to whom the disability of the II and III groups was established? In order to increase or decrease the disability group, in the absence of a limb or other health problems and/or based on the results of diseases or wounds received when protecting Ukraine. Limitedly suitable also undergoes a medical test, after which they must be recognized either suitable or not suitable for service.

In general, persons with disabilities during martial law can be called up for military service, but they can join the ranks of the Ukrainian army only at their own free will and on a contractual basis. The decision to mobilize such a person under a contract can be made only after a thorough physical examination and assessment of his ability to military service, and only at the place of residence. But in any case, the military person needs to go through the VVK and confirm the fact of disability.
