Analysts note that although the share of violations of the constitutional terms for the signing of laws has recently ceased to grow, however, the head of state systematically violates the term of 15 days for the signing of bills, which in fact should turn them into laws.

“This is an indicator of how the use of one inconsistency in the legislation can block the entire legislative process of the country. The Constitution provides that after the adoption of the law by the Verkhovna Rada, the president has two weeks to sign it or return with proposals. If he does not, the law is considered approved. However, in reality, this bill cannot enter into force, ”experts emphasize.

Such passivity is inherent not only to the current head of state, but also used by previous presidents. But if the law does not receive signatures, it hangs in a certain legislative vacuum.

As an example, LZI cites the bill “On Amending Certain Legislative Acts of Ukraine on Reforming the Sphere of Urban Development” No. 5655, which was sent to the president, but not signed or tested. Or the bill on raising excise taxes, which the president signed 3.5 months after adoption, because of which, according to the estimates of the People’s Deputy Yaroslav Zheleznyak, from January 1 the budget did not receive more than 2 billion hryvnias.

At the same time, it is virtually impossible to influence this situation, since the Constitution does not provide for a mechanism for coercive the president of Ukraine to sign the law.

“This is a“ quiet veto ” - a tool that allows you to actually ignore the decisions made by the Verkhovna Rada,” experts add.

The only way to change the situation is to make changes to the Constitution that clearly suggest what to do if the president does not sign the bill within the prescribed period. However, such changes will be possible only after the end of the war.
