In Colorado, prosecutor Dan Rubinstein (Dan Rubinstein) demanded to change the law, according to which the court of appeal released a prisoner sentenced to 324 years in prison. This is reported by runyweb with reference to the local newspaper The Daily Sentinel.
Rubinstein's indignation caused the decision of the State Supreme Court to release from punishment the pedophile Michael McFadden (Michael McFadden), who was found guilty of corrupting six children. The reason for the decision was a violation of the right of a man to trial the case within a reasonable time.
When the jury delivered a verdict in 2015, the defense continued to ask for a review of the decision. Lawyers asked several times to change the jury questionnaire, and therefore the final verdict was delayed, and his term exceeded the permissible.
Despite the fact that the defense was provoked by the delay, the appellate court found that the convict's guilt was not guilty, and decided to release McFadden from serving his sentence.
Rubenstein said that because of the country's too complicated judicial system in this situation, the prosecution has no way out. He urged the public to pay attention to the law and take action during the next election of state judges.
The right to a prompt trial is enshrined in the US Constitution. According to its sixth amendment, the defendants have the right to sentence "in a timely manner". If it is delayed and exceeds the period allowed in the state, charges from the defendant can be withdrawn.
