The Federal Supreme Court of Germany agreed to the extradition of a citizen of Ukraine, who, according to him, tried to avoid service in the Ukrainian army while abroad. This is the first time that the Ukrainian, evading the draft, was extracted from Germany. However, as it turned out, in his homeland he was charged with several crimes, reports the portal MDR.
Ukrainian law enforcement agencies filed a request for extradition of a man who left for Germany. His name was not disclosed, but it is known that in Ukraine he is accused of applying violence and threats to the policeman. When Germany began the extradition procedure, the accused stated that he had left to avoid the call, and was afraid that, having returned to his homeland, he would be forced to join the ranks of the Armed Forces.
The man said that he refused military service on moral beliefs, not wanting to participate in the murders. He emphasized that from the beginning of the war he was denied the right to such a refusal. In this regard, the Supreme Court of Dresden appealed to the Federal Supreme Court of Germany with the question whether an extradition request could be satisfied.
The court ruled that the rejection of military service on convictions is not a basis for refusing extradition. Also, the court decision emphasizes that the right to rejection of conscience is not absolute, and this right does not interfere with extradition in accordance with the Basic Law of Germany and the European Convention on Human Rights.
