Experts explained that Ukrainian legislation provides a number of grounds on which military personnel can be dismissed from military service, especially in the context of special circumstances during martial law, such as marital status, health conditions or caring for family members.

Adoptive parents, guardians, foster parents or patronage educators containing orphans or children deprived of parental guardianship.

Persons with disabilities in the family:.

If there is a child with disabilities up to 18 years old, in the absence of other persons obliged to educate him.

In cases where a serviceman supports an adult child with a disability of group I or II.

If a soldier brings up a child with severe diseases (oncology, cerebral palsy, type I diabetes mellitus in the presence of a corresponding medical opinion.

Care for close relatives:.

If it is necessary to constant care for the spouse, parents or family members who are persons with disabilities of the I or II group.

In cases of the need to carry out guardianship of a person recognized as a court, incompetent by a court decision.

Special cases in connection with the loss of close relatives:.

If close relatives (spouse, children, parents, brothers or sisters) of a serviceman died or went missing while participating in the ATO, defense measures or deterrence of Russian aggression.

If close relatives are posthumously awarded the title Hero of Ukraine for participating in the Revolution of Dignity.

Lawyers noted that in order to exercise their right to dismissal from military service, a serviceman must be provided with:.

A report on dismissal from military service, which is submitted to the immediate commander of the military unit to which the serviceman is subordinate.
