The High Council of Justice refused to grant consent to the prosecutor's office to detain judge Anatoly Ivchenko

On January 23, the High Council of Justice considered the submission of Deputy Prosecutor General Anton Voitenko to grant consent to the detention of judge of the Economic Court of the city of Kyiv Anatoly Ivchenko.

Members of the Supreme Court heard the position of the prosecutor's office and the position of the judge himself, as well as his lawyers, and asked relevant questions.

As a result, the majority of the present members of the Supreme Court voted against the consent to keep the judge in custody - 11. Three - Roman Maselko, Oleg Kandzyuba and Vitaly Salikhov - supported this proposal of the prosecutor's office.

We would like to remind you that on January 22, the Council of Judges of Ukraine decided to recognize the actions related to searches in the premises of the Economic Court of Kyiv and at the place of residence of judge Anatoly Ivchenko without identifying the investigating judge as containing signs of interference in the activities of the judge in the administration of justice and threatening judicial independence. The SSU also appealed to the Prosecutor General to initiate a verification of the facts of possible violations of the Code of Criminal Procedure during the pre-trial investigation and ensure that the SSU is informed about the results of the inspection within two months.

We also recall that the actions of the SBI related to the judge’s decision in September 2012 in case No. 5011-61/11340-2012. This decision was upheld by the decision of the Kyiv Economic Court of Appeal dated 3. 12. 2012 and by the decision of the Supreme Economic Court of Ukraine dated 21. 01. 2013, and by the resolution of the Supreme Court of Ukraine dated 20. 05. 2013. admission of the case to the proceedings of the Supreme Court of Ukraine was denied.
