Even during the war, Ukrainians can receive maternity assistance and go on leave at the birth of a child.. Specialists from the south-eastern interregional department of the civil service for labor issues explained whether an employer can refuse to grant leave to a father at the birth of a child..

Experts explained that if an employee is not involved in performing work at critical infrastructure facilities, then the employer cannot refuse to provide leave for the birth of a child.

“Labor legislation (Article 77-3 of the Labor Code of Ukraine) provides for the provision of one-time paid leave to employees upon the birth of a child for up to 14 calendar days,” the message says..

The government noted that the right to such leave is the father of the child or the husband whose wife gave birth to the child, or other relatives (if the mother or father of the child is single). This leave is granted to one person only.

To receive leave, the employee must contact the employer with an application no later than three months from the date of birth of the child..

“If an employee quits within three months from the date of birth of the child and finds employment at another enterprise (institution, organization), he can receive such leave by adding to the application a certificate stating that he did not use it at the previous place of work,” the message says..

This leave cannot be carried forward beyond the end of martial law..
