Overstaying: New EU entry system could put an end to it

In October 2024, a new entry-exit system EES may begin operating at the EU borders, which will significantly change the procedure for crossing the border with the European Union and Schengen countries. He recalled that the most popular way of illegal stay/employment of foreigners in the EU is to come legally (visa-free, tourist visa, etc.). ) and stay after the period of authorized stay has expired (for example, 90 days within the visa-free period or the period of the visa). Before the pandemic and Russia’s invasion of Ukraine, 20-40 thousand of our fellow citizens were caught doing this every year. Yes, of course, not only Ukrainians practice this tactic. Every year hundreds of thousands of irregular migrants are found in the EU (more than 600 thousand by 2022), a significant part of which are those who have exceeded their stay periods.

EES should end or at least significantly limit such possibilities.

Firstly, border guards will no longer manually count days using the stamps in the passport, which will eliminate the possibility of “slipping through” at the exit or entry, as well as the use of fake stamps.

Secondly (and this is even more significant), the system will automatically track the length of stay of the traveler in the EU and will add his/her name to the list of violators the moment the stay expires. Moreover, national authorities of EU/Schengen member countries will have access to this database, and this is probably the main change.

Where previously migration law violators were identified on the move or during “raids” or other selective control measures, now member countries will be aware of violators who may be on their territory in real time.

This is due to the fact that the main innovations of the EES are that travelers who will cross the EU border within the visa-free zone or with short-term visas will submit biometric data at the entrance - prints of the four fingers of the right hand (all except the thumb) and a photo. face. If you travel to the EU within the visa-free regime, the system will record the times of your entries and exits and the maximum permitted duration of stay.
