In Law 2486-IX " 10. 2022 - in the Final Provisions section, it is indicated who should ensure the access of the population to shelters, author ZN notes. UA, urban planning expert Georgy Mogilny on Facebook.
Local self-government bodies, heads of military-civilian/military administrations:. 5) within one month from the date of entry into force of the Law: to ensure unimpeded access of the population to protective structures of civil protection, dual-use structures, simple shelters.
The expert reports: “You see the RGA somewhere here or at least the KSCA? Everything is clear: CHI and VA. Therefore, the main responsible for the negligence that led to the victims are Vitaliy Klitschko, as the mayor of Kiev, and Sergei Popko, as the head of the KGVA. They are equally responsible, because the law conferred upon them both this authority."
According to him, when the President of Ukraine blames Vitali Klitschko for everything, he must simultaneously blame Sergei Popko, because if Klitschko is to blame, then Popko is also to blame..
The expert also notes that when the mayor of Kyiv puts the blame on the leadership of the RGA, he also misleads people.
"
Mogilny notes that Klitschko de facto admitted his guilt with stories about the allocation of 1.2 billion hryvnias from the budget of Kyiv to the RGA.
" Here, it is Klitschko who must ensure double control - both over the execution of the powers that, according to the law, the Kyiv City Council and its executive body had, but delegated to the RGA, and over the use of the money of the people of Kiev, transferred in the exercise of these powers,"
He also stressed that Volodymyr Zelensky cannot dismiss Klitschko from his post, because the head of the Kyiv City State Administration Klitschko did not violate anything - the Kiev mayor Klitschko violated, since the law places the responsibility for access to shelters on the compulsory medical insurance, and not state administrations.
However, according to Mogilny, Zelensky may dismiss Popk from the post of head of the KGVA.
" There will be a verdict - there will be the dismissal of Klitschko, the only one in two positions. But Zelensky will not take the case against Popk, whom he himself, having signed the law, appointed responsible for open bomb shelters. Therefore, ordinary bureaucrats will be appointed guilty,"
