The Ministry of Social Policy has developed three bills that propose to temporarily deprive certain categories of citizens of pension payments (temporarily refuse to assign them). The bills were published on the website of the Ministry for public discussion.
These are, in particular, the projects:.
On amendments to certain laws of Ukraine on the procedure for paying pensions to persons who have committed a crime against the foundations of the national security of Ukraine;
On amendments to Article 142 of the Law of Ukraine \;
On amendments to the Criminal Executive Code of Ukraine and the Criminal Procedure Code of Ukraine regarding the procedure for paying pensions to persons who have committed a crime against the foundations of the national security of Ukraine.
Although, according to the legislation of Ukraine, the state guarantees the right to pensions for all its citizens, including convicts, the Ministry of Social Policy believes that there are categories of convicts who are not affected by this right.. In particular, we are talking about persons who during the war supported the aggressor or went over to his side, committed criminal offenses against the foundations of the national security of Ukraine..
Thus, it is planned to stop paying a pension or not assign it to a person serving a sentence for committing criminal offenses under the following articles of the Criminal Code:.
109 (actions aimed at violent change of power);
110 (infringement on territorial integrity);
111 (high treason);
3-8 st. 111? 1 (collaborationism).
However, deprivation of pensions will not be forever.. The payment must cease from the date of entry into force of the judgment of conviction of the court.
But after serving a sentence in the form of restriction of liberty or imprisonment for the commission of a corresponding criminal offense, the payment of a pension will be resumed (may be assigned).
