Martial law: is it necessary for a student to register for military service

Due to the full-scale invasion of Russia in Ukraine, martial law is in effect and general mobilization has been announced, during which men of military age receive subpoenas and join the ranks of the Armed Forces of Ukraine.

Lawyer Igor Daineko stressed that even those students who have military IDs, and in the past were recognized, for example, as partially fit, should be renewed on the register at the TCC and the joint venture.

He recalled that the legal regime of martial law and general mobilization is currently in effect.. According to p. 3 of the Order of the Ministry of Defense No. 402, those liable for military service who are recognized as unfit for military service are re-examined by the IHC of the military commissariats at the place of residence after a mandatory examination in specialized medical and preventive institutions. A medical examination of this category of citizens is carried out according to column II of the Schedule of Diseases, and those with an officer rank - according to column III of this Schedule of Diseases.

According to Art.. 22 of the Law of Ukraine “On mobilization training and mobilization”, citizens are required to appear on a call to the territorial recruitment and social support center (conscripts, reservists of the Security Service of Ukraine - on a call from the Central Directorate or a regional body of the Security Service of Ukraine, conscripts, reservists of the Foreign Intelligence Service of Ukraine - on a call.

Thus, during the mobilization, persons liable for military service appear in the TCC and the joint venture to clarify the credentials, which will include, among other things, the passage of a second medical examination under section 3 of the Order of the Ministry of Defense No. 402 and are registered in the absence of grounds for deregistration.

The expert also recalled that students have grounds for exemption from conscription for mobilization under Art.. 23 of the Law of Ukraine "

According to Art.. 23 of the Law of Ukraine “On mobilization training and mobilization” of conscription during mobilization, applicants for professional (vocational), vocational higher and higher education, assistant trainees, graduate students and doctoral students studying full-time or forms are also not subject to a special period.

For this, a documented fact of having the status of a full-time student is sufficient.. To do this, it is necessary to submit a certificate of enrollment in the number of full-time students of the university along with an application in any form for a deferment to the TCC and the joint venture. Such a student should be granted a deferment and return a military registration document with the appropriate mark..

As a reminder, the deferral does not apply if a full-time or dual-study student wants to serve.
