The Constitutional Court of Ukraine declared unconstitutional the norm of the Criminal Procedure Code, which provides for the closure of criminal proceedings in the event of the entry into force of a law abolishing criminal liability for this act.

“On June 8, the Second Senate of the Constitutional Court of Ukraine adopted a decision on the case on the constitutional complaint of Oleksandr Vladimirovich Krotyuk on the conformity of the Constitution of Ukraine with the provisions of paragraph 4 of part one of Article 284 of the Criminal Procedure Code of Ukraine, according to which criminal proceedings are closed if “a law has come into force that abolishes criminal.

The author of the petition pointed out that the closure of criminal proceedings against the suspect violates the presumption of innocence, because it does not really prove the innocence of the accused.
