The Verkhovna Rada of Ukraine has registered a draft law proposing amendments to the Criminal Procedure Code of Ukraine and the Criminal Code of Ukraine, which, in theory, should simplify the procedure for exchanging convicts as prisoners of war.
One of the initiators of the bill No. 7436 is the chairman of the Verkhovna Rada Committee on National Security, Defense and Intelligence Fedor Venislavsky.
In order to speed up the procedure for the exchange of accused or convicted prisoners of war, the draft law proposes to provide for the possibility of closing criminal proceedings if the relevant authorized body decides to transfer the suspect, accused for exchange as a prisoner of war.
“Proceedings on the accused criminal proceedings may be closed by the court if the prosecutor has filed a motion to close it due to the fact that the relevant authorized body has decided to transfer the accused for exchange as a prisoner of war,” the explanatory note to the document says..
At the same time, if the exchange does not take place, the court may revoke its decision and continue the investigation or legal proceedings regarding the suspected prisoner of war..
If the prisoner of war released as a result of the exchange is again detained on the territory of Ukraine, the old proceedings will be resumed against him..
“Given the difficult situation, it is imperative to promptly resolve the issue of the exchange of accused convicted as prisoners of war,” the authors of the bill noted..
