Head of the Department of Special Investigations of the Prosecutor General's Office of Ukraine Sergei Gorbatyuk said that the GPU will appeal against the abolition of the search for former President Viktor Yanukovych by Interpol, the press service of the ministry.
Gorbatyuk said that the decision to remove Yanukovych from the search was taken by the Interpol Monitoring Commission in early March, and in April Interpol reported this to the GPU. At the same time, Ukrainian law enforcement officers were warned about the confidentiality of information and about the prohibition of its disclosure.
According to the prosecutor, the decision of Interpol is due not to shortcomings in the evidence base or procedural violations of the investigative authorities, but to the shortcomings of the Ukrainian legislation on the choice of preventive measures against the wanted persons and the status of the suspect.
A similar position was voiced by the Deputy Prosecutor General Yevgeny Enin.
"The court's decision on the authorization to detain in order to be brought to court to participate in the examination of the petition for choosing a preventive measure in the form of detention is not considered a decree on the detention of the suspect / accused in custody," wrote the deputy head of the GPU on his Facebook page on Wednesday evening, May 3.
And according to the rules of Interpol, a person in respect of whom a preventive measure in the form of detention has not been elected may not be declared internationally wanted.
"Separate district courts of Kiev refuse to pass resolutions on the application of preventive measures in the form of detention without the participation of a suspect. At the same time, these Interpol decisions have no significance for the start of a lawsuit on Yanukovych's charge of high treason, which will begin on May 4, "Yenin stressed..
"To date, Interpol's findings are being processed, which will result in a decision on further actions and, in particular, possible changes to the current legislation," the press service of the GPU said..
