NABU should learn the right to independently remove information from communication channels and conduct investigative actions under cover until the end of May 2017, said in a memorandum of Ukraine with the IMF.

According to the memorandum, the previous deadline for fulfilling this condition - the end of November 2016 - was not fulfilled and a new deadline was set for the end of May 2017.

Thus, legislative changes should be made to the Verkhovna Rada and adopted by the end of May (this is determined by the benchmark for cooperation with the IMF) in order to guarantee the possibility for the NABU to use a wide range of investigative methods without having to rely on the infrastructure of other departments, including: Cover, interception of messages, access to computer systems and control of correspondence.

In addition, the memorandum stipulates that registration of pre-trial cases and decisions of investigating judges related to the NABU should be protected from leakage of information related to ongoing investigations by limiting access to it to NABU officers and the Special Anti-Corruption Prosecutor's Office (SAP) While the investigation of the case is not completed or closed.

The Memorandum states that by the end of December 2016, NABU hired 542 employees out of 700 full-time employees and opened 3 regional branches. The NABU has demonstrated its ability to investigate high-ranking officials, in particular 8 members of parliament, 39 judges, 23 prosecutors.

At the same time, in cooperation with SAP, 40 cases were sent to court and led to the cancellation of the untouchability of a Member of Parliament.

In December 2016, Director of the NABU Artem Sytnik in an interview with ZN. UA stated that the authorities do not have the will and political will to provide NABU with the right to independently withdraw information from communication channels.
